What is Mediation

What is Mediation?

Mediation is a voluntary process through which parties commit themselves to the process. As a fully trained mediator, I act as the facilitating third party during the mediation process whilst remaining unbiased and impartial during all the proceedings.

Mediation opens communication channels and allows parties to reach an agreement that would not otherwise have been possible through litigation.

All parties involved can control the outcome and decisions. This process allows for a far more positive and less traumatic way to handle divorce and family disputes as both parties work toward establishing a healthy relationship with the other party once again. These efforts must continue even after the dispute is resolved for the mediation process to present remarkable results.

Mediation is an empowering process where all parties can take control into their own hands to reach a workable and reasonable agreement, suitable and acceptable to both parties. A safe, anxiety-free environment created by me as the mediator allows parties to communicate honestly and freely express their emotions.

Each individual and situation is unique and therefore, so is every dispute. As opposed to standard court systems that determine definitive agreements, mediation offers clients unique outcomes, agreements and solutions tailored to their unique situations.

The mediation process will allow each party to state their fears, concerns, needs, dissatisfaction and wishes.

It is not a win/lose battle or outcome but a joint settlement agreement that the parties are involved in to achieve a new perception of their relationship.

The mediator will formulate an agreement suitable to the client's unique circumstances once all parties involved have reached an agreement. The agreement can be submitted to the court to be made an order of the court but is not required in some cases. The agreement is signed by all the parties involved and is then legally binding depending on the nature, circumstances and needs of the parties involved in the dispute.
